These Terms & Conditions apply to purchases made through the A.D Guitars website at https://www.adguitars.co.uk/ and govern the sale of guitars and other products by A.D Guitars. By placing an order with A.D Guitars, you confirm that you have read and agree to these Terms & Conditions.

 

1. About A.D Guitars

 

A.D Guitars is an independent guitar business specialising in individually built, modified and finished guitars. For the purposes of these Terms & Conditions, "A.D Guitars", "we", "us" and "our" refer to A.D Guitars. "You" and "your" refer to the customer purchasing products from us.

 2. Products

 

Each guitar listed on our website is individually described and photographed. We aim to ensure that product descriptions, specifications and photographs accurately represent the guitar being offered for sale.

Due to the nature of individually built, modified and finished instruments, minor variations may exist between photographs, descriptions and the physical product.

Where a guitar has been described as handmade, custom-built, modified, refinished or otherwise individually produced, this will be stated in the relevant product description. Unless otherwise stated, guitars are sold as described on the individual product page. We reserve the right to correct genuine errors in product descriptions, specifications or pricing.

 

3. Product Condition

The condition of each guitar will be stated or reasonably identifiable from its individual product description. Where a guitar is used, modified, relic'd, refinished or intentionally distressed, any relevant characteristics will be described as clearly as possible.

 

Normal signs of wear, cosmetic imperfections or characteristics intentionally incorporated into a guitar will not be considered defects where they are clearly described or visible in the product listing. Nothing in these Terms & Conditions affects your statutory rights regarding products that are faulty, not as described or otherwise fail to meet the requirements of UK consumer law.

4. Prices

All product prices are displayed on the relevant product page. Prices are subject to change without notice, although changes will not affect an order that we have already accepted. Where applicable, delivery charges will be displayed separately before you complete your purchase. If we discover an obvious pricing error after you have placed an order, we will contact you before processing the order and give you the option to proceed at the correct price or cancel the order.

 

5. Placing an Order

When you place an order through the website, you are making an offer to purchase the product at the stated price.

An order is not considered accepted until we have confirmed acceptance of the order.

 

We reserve the right to decline or cancel an order where, for example:

 

  • the product is no longer available

  • there has been an obvious pricing or product description error

  • we are unable to verify or process payment

  • we reasonably suspect fraudulent activity

  • circumstances outside our reasonable control prevent us from fulfilling the order.

 

If we cancel an order after payment has been taken, you will receive a full refund of the amount paid.

 

6. Payment

Payment must be made using the payment method(s) available through the website at the time of purchase.

We will only process and dispatch an order once payment has been successfully received and, where applicable, cleared.

You confirm that you are authorised to use the payment method provided.

 

7. Delivery

We will provide information about available delivery options and associated costs before you complete your order.

We aim to dispatch products within the timeframe stated on the relevant product page or otherwise communicated to you.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, adverse weather or other logistical issues.

 

Unless otherwise agreed, goods should be delivered within 30 days of the contract being entered into. Once your order has been dispatched, you may receive tracking information where this is available. For high-value guitars, we may require a signature upon delivery. If an item arrives visibly damaged, please contact us as soon as reasonably possible and provide photographs of the packaging and product where appropriate.

8. International Orders

Where international delivery is offered, the customer is responsible for providing accurate delivery information. Customers outside the UK may be responsible for customs duties, import taxes or other charges imposed by the destination country. A.D Guitars cannot be responsible for delays caused by customs or import procedures. International delivery availability may vary depending on the destination.

9. Your Right to Cancel

If you are a consumer purchasing a product online, you generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason. If you wish to cancel, you should contact us clearly stating that you wish to cancel your order.

After notifying us of your cancellation, you must return the goods within 14 days. Unless the product is faulty, damaged or incorrectly supplied, you will normally be responsible for the direct cost of returning the goods.

 

We will refund the purchase price and, where required by law, the original standard delivery charge. Refunds will normally be made using the same payment method used for the original transaction. We may delay the refund until we have received the returned goods or you have provided evidence that they have been returned, whichever occurs first.

 

10. Condition of Returned Goods

You are responsible for taking reasonable care of a guitar while it is in your possession. You may handle and inspect the guitar to establish its nature, characteristics and functionality in the same way you would reasonably be able to do in a shop. If the value of the guitar has been reduced because it has been handled beyond what is reasonably necessary to inspect it, we may be entitled to make a deduction from the refund where permitted by law. Returned guitars should, where reasonably possible, be securely packaged to prevent damage during transportation.

11. Exceptions to the Right to Cancel

Certain products may be exempt from the standard 14-day cancellation right where an applicable legal exception applies.

This may include products that have been made to the customer's specific requirements or have been clearly personalised.

If you request a guitar to be specifically customised, modified or produced to your individual requirements, we will inform you before the order is confirmed if this affects your cancellation rights. This does not affect your statutory rights if the product is faulty, not as described or otherwise fails to meet the requirements of consumer law.

12. Faulty, Damaged or Incorrect Products

 

Your statutory rights are not affected by these Terms & Conditions. Under UK consumer law, goods should be of satisfactory quality, fit for purpose and as described. If you receive a guitar that is faulty, materially different from its description or incorrectly supplied, please contact us as soon as possible. Depending on the circumstances and your legal rights, we may offer a repair, replacement, price reduction or refund. If you believe an item is faulty, please contact us before arranging any repairs or modifications yourself. We may ask for photographs, videos or other information to help us understand the issue. Nothing in these Terms & Conditions limits or excludes any liability that cannot legally be limited or excluded.

13. Modifications and Customer Alterations

A.D Guitars cannot accept responsibility for faults, damage or deterioration caused by modifications or alterations carried out by the customer or by a third party after purchase. This may include, but is not limited to:

  • replacement or modification of pickups

  • alterations to wiring or electronics

  • changes to hardware

  • structural modifications

  • refinishing or repainting

  • changes to the neck, frets or setup

  • other unauthorised alterations

This does not affect your statutory rights in relation to faults that existed before such modifications were carried out.

 

14. Guitar Setup and Maintenance

Guitars are made from natural materials and may require adjustment depending on their environment, temperature, humidity and method of use. Minor changes to setup, including action, intonation or neck relief, can occur during transportation or as the guitar acclimatises to a new environment. Routine setup or maintenance required as a result of normal use or environmental changes is not necessarily considered a product defect. We recommend that guitars are stored and maintained in suitable environmental conditions and handled appropriately.

15. Product Availability

Many A.D Guitars products are individually produced and may be unique or available in limited quantities.

Where a product is listed as sold out or unavailable, this does not necessarily mean that an identical replacement will be produced.

We may remove products from the website at any time.

16. Intellectual Property

All photographs, product descriptions, logos, graphics, website content and other material displayed on the A.D Guitars website are owned by or licensed to A.D Guitars unless otherwise stated. You may not reproduce, distribute, modify or commercially use our website content without prior written permission.

 

17. Website Accuracy

We make reasonable efforts to ensure that information displayed on the website is accurate and up to date.

However, we cannot guarantee that the website will always be free from errors, interruptions or technical issues.

We reserve the right to update, amend or remove website content where necessary.

 

18. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful. In particular, nothing in these Terms & Conditions excludes or limits your statutory consumer rights or our liability for matters that cannot legally be excluded or limited. Subject to the above, A.D Guitars will not be responsible for losses that were not reasonably foreseeable at the time the contract was entered into.

19. Complaints

If you have a problem with an order or product, please contact us using the details provided on our Contact page.

We will aim to investigate and resolve complaints as quickly and fairly as possible. Please provide your order details and a clear description of the issue so that we can assist you efficiently.

20. Privacy

Any personal information provided when placing an order will be handled in accordance with our Privacy Policy. We may use your information to process orders, arrange delivery, communicate with you regarding your purchase and meet our legal and accounting obligations.

21. Changes to These Terms

We may update these Terms & Conditions from time to time. The version applicable to your purchase will be the version displayed on the website at the time you place your order.

 

22. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. If you are a consumer, you will also retain any mandatory rights and protections provided by the laws that apply to you.

 

23. Your Statutory Rights

Nothing in these Terms & Conditions is intended to restrict or remove any rights you have under applicable UK consumer protection legislation. Where these Terms & Conditions conflict with mandatory consumer protection law, the relevant legal requirements will apply.
